Article 1 - General Provisions

Unless otherwise expressly agreed between the buyer and the seller:

Any order placed for a product listed in the online store of www.roccamaura.com implies prior consultation of these general terms and conditions. Consequently, the consumer acknowledges being fully informed that their agreement regarding the content of these general terms and conditions does not require a handwritten signature of this document, as long as the client wishes to order products online as presented in the online store.

The consumer has the option to save or print these general terms and conditions, it being specified that both saving and printing this document are their sole responsibility.

Article 2 - Offer and Order

The site offers a commercial proposal for the sale of products at all times. Product offers are not permanent. They are valid while stocks last, as long as the products are displayed on the site. In the event of stock depletion, the seller reserves the right to deliver a product with identical quality characteristics.

The sales contract will only be concluded after acceptance and confirmation of the order by SCA Rocca Maura (by sending an order confirmation through any appropriate means: email, fax, or letter). The photographs illustrating the products are not part of the contractual field; therefore, they cannot engage the liability of SCA Rocca Maura.

Orders placed online and validated according to the established process, unless exercising the legal right of withdrawal, are firm and final. Validation of the order form constitutes acceptance of the specific terms displayed on the screen, namely the product's name and characteristics, quantities, and price. The system implemented by SCA Rocca Maura is considered the only valid proof of the nature, content, and date of the order.

SCA Rocca Maura reserves the right not to confirm an order and therefore not to record a payment for any reason beyond its control (especially for non-compliance with these general terms of sale, supply issues, disputes related to a previous order).

Article 3 - Price

Prices are indicated in Euros, inclusive of all taxes (VAT), and are valid only on the date the order form is sent by the consumer.

SCA Rocca Maura reserves the right to modify its prices at any time. Payment of the total price must be made at the time of the order. At no time can the sums paid be considered as deposits or down payments.

Article 4 - Payment

All sales are made on a cash basis.

The consumer guarantees SCA Rocca Maura that they have the necessary authorizations to use the payment method chosen at the time of validating the order form.

SCA Rocca Maura reserves the right to suspend any order management and delivery in the event of payment authorization refusal by officially accredited organizations or in the case of non-payment.

SCA Rocca Maura specifically reserves the right to refuse delivery or to honor an order from a consumer who has not fully or partially paid for a previous order or with whom there is an ongoing payment dispute.

Article 5 - Retention of Ownership

In accordance with Law 80-336 of May 1, 1980, the seller retains ownership of the goods sold until full payment of the principal and any incidental costs. However, the risks are transferred to the buyer upon delivery. Failure to pay any due amount may result in the return of the delivered goods and, if the seller so wishes, termination of the contract.

Article 6 - Delivery and Timeframes

All products from SCA Rocca Maura are available for delivery within mainland France, within 12 business days from the time of payment by credit card.

Delivery can be made to your home, workplace, or any other address specified during the order process. However, the entire order can only be delivered to one address.

The delivery times provided are indicative. A delay does not, unless otherwise agreed between the parties, justify the cancellation of the order or a claim for damages.

The customer is required to check the condition of the goods upon receipt from the carrier. In case of missing items or breakage, the customer must refuse all or part of the package and note the reason on the carrier's delivery slip.

The carrier will then inform SCA Rocca Maura. Upon receipt of this information, SCA Rocca Maura commits to immediately reship an identical package to the recipient.

In no case can the customer demand a refund of the product or the delivery fees.

Article 7 - Satisfaction or Refund

The consumer has 7 business days to return, at their expense, any products that do not meet their expectations. This period begins on the day of delivery.

All returns must first be reported to SCA Rocca Maura by email at vpc@roccamaura.com or by fax at +33 (0)4 66 82 67 28.

Products must be returned in their original packaging, complete, intact, and in perfect resale condition to the following address:

Packages returned damaged or incomplete will not be accepted.

This right of withdrawal is exercised without penalty, except for the return shipping costs.

If the right of withdrawal is exercised, the consumer may choose either a refund or an exchange of the product. In the case of an exchange, the new shipment will be at the consumer’s expense.

In the event of withdrawal, SCA Rocca Maura will reimburse the consumer within 15 days. The refund will be made to the consumer’s bank account (secure transaction) or by check.

Article 8 - Data Protection and Privacy

SCA Rocca Maura commits not to disclose any personal information provided by you to third parties. This information is confidential and will only be used by its internal services for order processing.

This information will only be used or disclosed when necessary for order management or to meet legal and regulatory obligations.

In accordance with Article 27 of Law 78-71 of January 6, 1978, relating to information technology, files, and civil liberties, you have the right to access, rectify, and oppose your personal data.
